Opportunity Drawing Entry Rules

1. Mail-in/fax-in entries must be received in the Development Department of the California Science Center Foundation by 5:00 p.m. PST on March 19, 2010 at 700 Exposition Park Drive, Los Angeles, CA 90037 or (213) 744-2240 (fax). The Science Center is not responsible for misdirected mail or malfunctions in fax transmittal. Additional entries, up to 300 in total, will be accepted during the Ecosystems Grand Opening Gala on the evening of March 20, 2010;

2. The winning entry will be selected by random drawing from no more than 300 entries conducted during the Ecosystems Grand Opening Gala on the evening of March 20, 2010. Winner need not be present, and will be contacted by phone or email if not in attendance at the drawing. An alternative winner will be selected by random drawing if the winner: fails to execute and notarize the affidavit of eligibility and liability/publicity release within 14 days of notification; does not pay the required withholding tax; or is otherwise determined to be ineligible. Decisions of the California Science Center Foundation are final. The name of the winner may be obtained by calling (213) 744-2035;

3. Entrants must be legal residents of the continental United States, at least 18 years of age by March 20, 2010 with a valid driver’s license and able to present evidence of adequate insurance;

4. The opportunity drawing prize is a 2010 Lexus HS 250h (“Donated Vehicle”), with estimated base value of approximately $40,000. All prizes shall be awarded;

5. The winner of the Donated Vehicle may not be an employee, or immediate family member or anyone domiciled with any such employee, of Toyota Motor Sales, U.S.A., Inc. (“TMS”), that entity’s advertising agencies, or any of the aforementioned entities’ affiliates or subsidiaries;

6. The winner of the Donated Vehicle may not be an employee, or immediate family member or anyone domiciled with any such employee, of the California Science Center/California Science Center Foundation (“Charity”);

7. Prizes are non-transferable, and no substitutions on any prizes (except that Charity and/or TMS reserve the right to substitute prizes of equal or greater value);

8. TMS and Charity shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury or death in connection with the prizes provided pursuant to the opportunity drawing; provided, however, that TMS shall be solely responsible for any express written limited warranties specifically set forth in the applicable Owner’s Guide for the Donated Vehicle;

9. The depiction of the Donated Vehicle in any advertising or promotional materials may not reflect the actual vehicle delivered to the winner;

10. The opportunity drawing shall be staged in compliance with all applicable federal, state and local laws;

11. The opportunity drawing shall be void where prohibited or restricted by law;

12. The winner (and if the winner is a minor in his/her jurisdiction of residence, his/her parent or legal guardian) shall be required to execute and notarize an affidavit of eligibility and liability/publicity release and return such affidavit to Charity within 14 days of notification or an alternative winner shall be selected;

13. The Donated Vehicle shall only be delivered in the continental United States. If the winner lives within a reasonable distance of TMS’s Torrance, California headquarters’ offices, the winner shall execute the necessary paperwork and take delivery of the Donated Vehicle at TMS’s principal place of business in Torrance, California. Otherwise, TMS shall use reasonable efforts to have the Donated Vehicle delivered to the authorized Lexus dealership closest to the winner’s primary residence in the continental United States;

14. The winner shall be responsible for all taxes, license, title and registration fees and any other costs, including without limitation any travel or transportation costs, associated with winning the Donated Vehicle, and Charity shall be responsible for collecting the withholding tax at a 25% rate from the winner;

15. TMS shall not be responsible for delays in delivery of the Donated Vehicle, and delivery is subject to availability. TMS, however, shall use all reasonable efforts, subject to availability, to deliver the Donated Vehicle within 180 days after receipt of the aforementioned items/information. The winner shall bear all risk of loss or damage to the Donated Vehicle after it has been delivered to the specified delivery site. The winner must personally retrieve the Donated Vehicle within 14 days of written notification of delivery and must present adequate personal identification and evidence of legally required insurance (or an alternative winner shall be selected and the original winner’s rights to the Donated Vehicle shall be automatically forfeited); and

16. Acceptance of a prize constitutes permission for Charity and TMS and/or their designees to use the winner’s name, address, photograph, testimonial or other likeness and/or prize information or personal exposition (and/or any edited portion thereof) for promotional, advertising and/or publicity purposes in any media, now or hereafter known throughout the world in perpetuity, without compensations or notice to, or further consent of, the winner to the extent permitted by law.
